End User Agreement

Effective Date: January 7, 2025

1. Introduction

Welcome to Power Underwriter. By accessing or using our SaaS platform, you agree to comply with and be bound by this End User Agreement (“Agreement”). Please read it carefully.

2. Definitions

  • “Service” refers to the Power Underwriter SaaS platform.
  • “User” refers to any individual or entity using the Service.
  • “Content” refers to all information, data, text, software, or other materials uploaded to or generated by the Service.

3. Use of Service

Users are granted a non-exclusive, non-transferable license to access and use the Service in accordance with this Agreement and any accompanying documentation.

4. User Responsibilities

Users agree to:

  • Provide accurate and complete information during registration.
  • Maintain the confidentiality of their account credentials.
  • Use the Service in compliance with all applicable laws and regulations.

5. Prohibited Activities

Users shall not:

  • Reverse engineer, decompile, or disassemble the Service.
  • Use the Service for any unlawful or fraudulent activities.
  • Introduce viruses or other malicious code into the Service.

6. Data Ownership and Privacy

  • Users retain ownership of all Content they upload to the Service.

7. Limitation of Liability

To the fullest extent permitted by law:

  • No Warranties: The Service is provided “as is” without any warranties, express or implied.
  • Exclusion of Damages: Power Underwriter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or relating to your use of the Service.
  • Liability Cap: In no event shall Power Underwriter’s total liability exceed the amount paid by the User for the Service in the twelve (12) months preceding the claim.

8. Indemnification

Users agree to indemnify and hold harmless Power Underwriter from any claims, losses, liabilities, damages, expenses, and costs, including reasonable attorneys’ fees, arising out of or related to their use of the Service or violation of this Agreement.

9. Termination

Power Underwriter reserves the right to suspend or terminate access to the Service for any User who violates this Agreement or engages in activities that may harm the Service or its users.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.
